Restructuring Tertiary Institutions

This page provides guidelines as to how institutions can implement a degree program, merge, or otherwise restructure to form a recognized institution of tertiary learning.


Commencement of a Degree Program (Upgrading a College to Univesrity Status)

Example: C.A.S.T. to the University of Technology, Jamaica

  1. Cabinet decides that the country needs another university and MOEYC identifies and the institution with the potential for upgrading.
  2. The MOEYC establishes a task force comprising representatives of the institution, the MOEYC, the private sector and other institutions and agencies as the Minister sees fit.
  3. Task force report is submitted to the MOEYC. This includes strategic plan for the institution.
  4. Based on acceptance of the report, a Cabinet submission is written by the Tertiary Unit.
  5. Cabinet approves or disapproves of the decision.
  6. If approval is granted, MOEYC makes relevant announcement, usually in Parliament.
  7. Process begins for legal framework, including name change and charter.
  8. Restructuring of institution commences with the new staff structure and upgrading of physical facilities and student services.

e.g. Early Childhood Programme at Shortwood

  1. MOEYC agrees that a degree programme is needed in a particular area, following consultation with various stakeholders e.g. the institution, university.
  2. Institution submits proposal to MOEYC after inputs from partners in the programme.
  3. Proposal is examined by the tertiary unit and others in MOEYC on the basis of criteria established by MOEYC A major criterion is sustainability.
  4. MOEYC approves or disapproves. If approval is granted, a Cabinet submission is prepared by the unit and submitted.
  5. Cabinet approves or disapproves. If approval is granted, MOEYC makes the announcement.
  6. Formal agreements are signed between the partners in the programme.
  7. Provision is made for budgetary allocation for the new programme.

Merging of Two or more Institutions

Example: Merging of C.O.A. and P.G.T.C. to form C.A.S.E.

  1. Cabinet takes a decision to merge institutions, usually in the interest of cost-effectiveness and expansion of programmes.
  2. MOEYC establishes technical committee to begin discussions.
  3. Technical committee conducts institutional analysis and makes recommendations.
  4. New structure is drafted after consultation with all parties.
  5. Report of technical committee and draft of new structure are submitted to MOEYC.
  6. MOEYC approves or disapproves.
  7. If approval is granted, a submission is made to Cabinet.
  8. If Cabinet approves, the process for legal framework begins. This takes approximately nineteen (19) steps and usually culminates in a new scheme order which merges the two institutions.
  9. Implementation of new staff structure and integration of the institution begins.

Restructuring and Upgrading

E.g. The Cultural Training Centre to the Edna Manley College

  1. Cabinet decision to restructure the Cultural Training Centre and to give it more autonomy within the MOEYC.
  2. MOEYC takes steps to implement the decision.
  3. First step is the removal of the institution from the Institute of Jamaica (IOJ).
    This takes nineteen (19) steps.
  4. New staff structure is developed after consultation with various GOJ bodies and the institution.
  5. New institution is launched. A change of name is usually necessary.
  6. Name change is gazetted.
  7. Implementation of new structure begins.
  8. Preparation for new legal framework commences. This usually results in a new scheme order. This requires a further nineteen (19) steps.

Process of moving from IOJ to MOEYC

Example: The Cultural Training Centre to the Edna Manley College

  1. Cabinet approval for institution to be a tertiary institution under MOEYC
  2. Cabinet approval to draft legislation to amend IOJ Act.
  3. MOEYC instruction to Parliamentary Counsel to draft legislation.
  4. Drafting of legislation.
  5. Attorney General's comments on draft legislation.
  6. Parliamentary Counsel redrafts of legislation.
  7. MOEYC receives draft legislation.
  8. Draft legislation approved by legislation committee of Parliament for submission to Cabinet.
  9. MOEYC receives approved legislation and submits to Cabinet.
  10. Cabinet receives legislation - approves for submission to House of Parliament.
  11. MOEYC submits legislation to Clerk of Parliament.
  12. Legislation printed and submitted to Lower House.
  13. Tabling and notice of first reading.
  14. Lower House approves submission for presentation to Upper House after second reading, debate and approval.
  15. Upper House approves legislation after debate and possible amendments.
  16. Printing Office prints Bill.
  17. Attorney General reads Bill and advises the Governor General.
  18. Governor General signs Bill.
  19. Gazetting of Bill.
